South Dakota Clean Skies Bill Draft
A BILL TO ENSURE CLEAN SKIES IN SOUTH DAKOTA
Section 1. Title This Act shall be known as the “South Dakota Clean Skies Act of 2025.”
Section 2. PurposeThe purpose of this Act is to protect the health, environment, and liberty of South Dakota citizens by prohibiting the intentional release of chemicals into the atmosphere for geoengineering purposes, ensuring the state’s skies remain free from pollution and unauthorized weather modification.
Section 3. Definitions(a) “Geoengineering” means the intentional injection, release, or dispersion, by any means, of chemicals, chemical compounds, substances, or apparatus into the atmosphere with the express purpose of affecting temperature, weather, or the intensity of sunlight.(b) “Weather Modification” includes practices such as cloud seeding or stratospheric aerosol injection (SAI) intended to alter atmospheric conditions.
Section 4. Prohibition(a) It is unlawful for any person, entity, or governmental body, including the federal government or its agents, to engage in geoengineering or weather modification activities within the borders of South Dakota by intentionally dispersing chemicals into the atmosphere.(b) This prohibition does not apply to routine agricultural practices, emergency fire suppression, or other activities explicitly authorized by state law.
Section 5. Enforcement(a) The South Dakota Department of Environment and Natural Resources shall enforce this Act.(b) Violations of this Act shall result in a fine of up to $50,000 per incident, with repeat offenses subject to additional penalties, including potential imprisonment for up to one year for willful violations.(c) Citizens may report suspected violations to local sheriffs, who shall investigate and coordinate with state authorities.
Section 6. State SovereigntyPursuant to the Tenth Amendment of the U.S. Constitution, South Dakota asserts its sovereign right to protect its citizens from unauthorized atmospheric pollution, rejecting federal or international geoengineering programs that lack state consent.
Section 7. Effective Date this Act shall take effect on July 1, 2025. or so
